What kind of issues can i call about?

The practice resource consultation will:
  • Serve as a resource to registrants and non-registrants (e.g. students) regarding legislative, regulatory and ethical matters as they relate to specific occupational therapy practice scenarios in the province of Ontario;
  • Consult to the public and other professionals and stakeholders in regard to the standards of Occupational Therapy practice;
  • Act as a referral/liaison with other College staff, other organizations (e.g. professional associations, regulatory bodies, government services) that offer relevant resources;
  • Consult with appropriate resources regarding legal, legislative and ethical matters as they pertain to practice issues;
  • Participate in research and development for standards and best practice requirements for Occupational Therapy practice.

What are the limitations of the practice resource service?

Limitations of the practice resource service:
  • The Practice Resource Consultant cannot offer a legal opinion or legal advice. In cases where the College has sought a legal consult on a specific matter the information may be shared with the caller / enquirer with a written summary / documentation of the opinion to refer to - i.e. newsletters / articles / case law.
  • The Practice Resource Consultant will not provide an opinion on the actions of a caller as it relates to complaints or disciplinary decisions/action on the part of the College.
  • Information and/or assistance provided by the Practice Resource Consultant will not take the form of specific instruction or direction except where it is necessary in the interest of public safety.
  • Information provided by a caller will remain confidential and will not be shared or used by other programs/departments of the College except in the following situations:
    • where action is taken against the College in relation to the information/consultation provided,
    • where the College has a legal obligation to release the information (e.g. discovery purposes at Discipline),
    • where it is necessary in the interest of public safety (duty to warn,
    • where the caller has requested and therefore consented to the release.

What are the responsibilities of the caller?

Where appropriate, the service recipient is encouraged to utilize College resources independently (College website, registrant resource binder) to assist their own decision-making. The service recipient will be directed to these and other sources of information as appropriate.

Where the issue concerns legislation beyond the scope of the College, and / or legal matters, the service recipient is encouraged to seek their own professional / legal advice.

Information obtained in the course of discussions is documented and is kept confidential (see limitations). Service recipients will be informed of this and asked for verbal permission to share details of their information when consultation about their issue is required.
