Sometimes, an occupational therapist (OT) might not meet the standards of practice for the professional or might breach a regulation. If that happens, the College of Occupational Therapists of Ontario takes action.
Discipline of professionals is a critical part of self-regulation and maintaining public trust.
Inquiries, Complaints and Reports Committee
When complaints arrive at the College, the Inquiries, Complaints and Reports Committee (ICRC) investigates. Sometimes, the ICRC believes the information suggests professional misconduct or incompetence by an occupational therapist. In those cases, the ICRC may refer allegations to the College’s Discipline Committee.
The Discipline Committee holds hearings, which are similar to court proceedings and are open to the public.
About discipline hearings
A discipline hearing is the most serious proceeding that a regulated health professional can face and carries with it the risk of loss of registration.
Hearing panels include members of both the profession and the public. If a hearing results in a finding of guilt, the Discipline Committee can order a range of appropriate penalties for an occupational therapist, including:
- a reprimand;
- restrictions on an occupational therapist’s registration, called terms, conditions or limitations; and
- suspending or revoking an occupational therapist’s Certificate of Registration.
Occupational therapists may also be required to reimburse the College, for the cost of funding counselling for patients in sexual abuse cases and/or for the College’s legal, investigation and hearing costs and expenses.
Disciplinary decisions
Any disciplinary decisions are made in the best interests of the public and a summary of the decisions are available online at Find an Occupational Therapist at the conclusion of the hearing.
A copy of the full text of any discipline decision summarized on Find an Occupational Therapist may be requested from College staff or for decisions made on or after December 2017, is available on CanLII (The Canadian Legal Information Institute).
